Vinyrd ("we," "our," or "us") respects your privacy. This Privacy Policy explains how we collect, use, store, and share your personal data when you use the Vinyrd iOS application, and outlines your rights under applicable privacy laws, including the General Data Protection Regulation (GDPR/UK GDPR) and US state privacy laws (such as the CCPA/CPRA).

We collect personal information directly from you and automatically through your use of the app, including:

• Account & Contact Data (Identifiers): Name, email address, and account credentials.
• User Content & Activity: Wine reviews, ratings, comments, and saved preferences.
• Scan Images (Visual Data): Photos of wine labels or lists you capture in the app.
• "Ask Vinyrd" Queries: Text prompts and search context submitted to our AI assistant.
• Technical & Device Data (Internet Activity): IP address, app interaction logs, device identifiers, and crash reports.

3. How We Use Your Data

We process your personal data for the following purposes:

• To Provide the Service (Contractual Necessity): Operating your account, maintaining ratings, scanning labels, and delivering personalised recommendations.
• To Improve & Secure the Service (Legitimate Interest): Analysing usage, monitoring performance, fixing bugs, and enhancing AI capabilities.
• To Support Users (Legitimate Interest): Responding to your customer service inquiries.
• Legal Compliance (Legal Obligation): Complying with tax, accounting, or regulatory requirements.

4. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected:

• Account & User Content: Stored for as long as your account is active. Personal data is permanently deleted with your account deletion.
• Wine Label/List Images: Stored on device only.

5. Third-Party Services & International Data Transfers

We share data with trusted vendors who act as Data Processors/Service Providers bound by strict confidentiality terms:

• Supabase: Primary database hosting and user authentication.
• Fastcork & Wine Labs: Processing wine label images and fetching metadata.
• Google (Firebase & Gemini API): App analytics, infrastructure, and AI query processing.

International Transfers: Your data may be transferred to and stored on servers located outside the EEA/UK (primarily in the United States). Where applicable, we rely on official transfer mechanisms such as the EU-U.S. Data Privacy Framework or standard contractual clauses (SCCs) to safeguard your data.

Depending on your jurisdiction (e.g., EU/UK or US states like California, Virginia, Colorado), you hold specific rights:

Vinyrd is intended exclusively for adults of legal drinking age. We do not knowingly collect personal data from minors. If we discover a user is below the legal drinking age, we will promptly delete their account and associated data.

1. Acceptance of Terms

By downloading, accessing, or using the Vinyrd application ("App"), you agree to be bound by these Terms of Use ("Terms").

2. Age Requirement

Vinyrd is intended solely for users who are of legal drinking age in their jurisdiction of residence. By using the App, you represent and warrant that you meet this age requirement.

3. Medical and Health Disclaimer

Drink Responsibly. Vinyrd provides information and AI-driven recommendations related to wine. This information is for educational and entertainment purposes only. We do not promote excessive or underage drinking. Vinyrd is not responsible for any health issues, damages, or legal consequences resulting from your consumption of alcohol.

4. User Accounts and Content

• Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Your Content: You retain ownership of the reviews, ratings, and photos ("User Content") you submit. By submitting User Content, you grant Vinyrd a non-exclusive, worldwide, royalty-free license to use, display, and process this content to operate and improve the App.
• Prohibited Conduct: You agree not to submit content that is illegal, offensive, discriminatory, or infringes on the intellectual property rights of others. Additionally, you agree not to attempt to circumvent any security or safety controls, reverse-engineer the App, or otherwise compromise the security and integrity of the App or its underlying systems. We reserve the right to remove any content or terminate accounts at our sole discretion for any violation.

5. Intellectual Property

All original content, features, and functionality of the App (excluding your User Content) are owned by Vinyrd and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without prior written consent.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Vinyrd makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the App, including the accuracy of any wine information or AI-generated recommendations (such as "Ask Vinyrd").

7. Limitation of Liability

To the maximum extent permitted by law, Vinyrd and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any bugs, viruses, or the like that may be transmitted to or through our App by any third party.

8. Third-Party Services

The App utilizes third-party services. Your use of the App is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the availability or accuracy of these external services.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including a breach of these Terms.
